IN CHAMBERS - COURT ORDER by Judge Percy Anderson: Before the Court is a Motion to Dismiss filed by defendant Fifth Third Bank, N.A., as successor by merger to Comerica Bank ("Defendant" or "Comerica") (Docket No. 14). Pursuant to Rule 78 of the Federal Rules of Civil Procedure and Local Rule 7-15, the Court finds that this matter is appropriate for decision without oral argument. The hearing calendared for August 31, 2026, is vacated, and the matter taken off calendar. For all of the foregoing reasons, the Court grants Comerica's Motion to Dismiss. The Court therefore dismisses Plaintiff's Complaint without leave to amend and with prejudice. The Court will issue a Judgment consistent with this Order. Granting 14 MOTION to Dismiss Case.
