The parties appeared for oral argument regarding defendants' motions for certification of an interlocutory appeal and a corresponding stay (Dkt. Nos. 742, 743). The Court heard argument and took the matter under advisement, to be decided if the settlement conference fails to resolve the case. The Court discussed the possibility of settlement, and counsel advised that they are amenable to participating in a settlement conference, subject to their clients' approval. The Court referred the matter to Magistrate Judge Roemer for the settlement conference. The parties shall confer with Judge Roemer promptly to schedule the settlement conference, and shall file a joint status report regarding settlement efforts on or before August 27, 2026. The Court scheduled a four-week jury trial, with jury selection to begin on February 8, 2027, at 9:30 a.m. Chambers will circulate a draft pretrial order for counsel to complete with proposed deadlines working towards that trial.
