TEXT ORDER: On February 23, 2024, this Court entered a final order discharging the receiver and closing the action. Dkt. No. 552 . On August 19, 2026, pro se defendant Steven A. Erby filed an emergency motion for limited reopening, temporary preservation order, sworn accounting, and expedited status conference. Dkt. No. 553 . Out of an abundance of caution, the Court ordered the receiver to respond. Dkt. No. 554 . The receiver has since done so. Dkt. No. 555 . There, the receiver points out that defendant Erby was on notice of the final round of motion practice in this case (i.e., the receivers request to abandon the remaining assets and be discharged as receiver), and had the opportunity at that time to seek relief (which he did not do). Id. Upon review of the submissions, defendants motion is DENIED in all respects. This action remains CLOSED. So Ordered by Senior Judge David N. Hurd on 9/21/2026.
