Order on Motion to Withdraw as Attorney
ORDER granting 117 Motion to Withdraw as Attorney. On July 22, 2026, counsel for Plaintiffs filed a motion to withdraw. ECF No. 117. On July 24, 2026, the Court ordered that any opposition to the motion be filed by July 31, 2026. ECF No. 120. No opposition to the motion was filed. Accordingly, the Court GRANTS the motion to withdraw as unopposed, subject to the following requirements: (1) counsel shall serve a copy of this Order on Plaintiffs by August 5, 2026, and file proof of such service by August 7, 2026; and (2) counsel shall, in that proof of service, provide an address for Plaintiff BernardCarl to which orders can be sent going forward.A corporate entity may appear in federal court only through counsel. See Lattanzio v. COMTA, 481 F.3d 137, 140 (2d Cir. 2007). Accordingly, the corporate Plaintiffs are to appear by new counsel by August 24, 2026. If they fail to do so, the claims of the corporate Plaintiffs may be dismissed for failure to prosecute without further notice to the parties. See, e.g., V.D.B. Pac. B.V. v. Chassman, 277 F.R.D. 121, 126 (S.D.N.Y. 2011). By contrast, the individual Plaintiff, Bernard Carl, is deemed to be proceeding pro se unless and until counsel enters a notice of appearance on his behalf. No later than August 24, 2026, counsel shall appear on his behalf or he shall file a letter indicating his intention to proceed with this matter. In the absence of new counsel or such a filing by that date, Carls claims may be dismissed for failure to prosecute without further notice to the parties. The Clerk of Court is directed to terminate ECF No. 117 and to terminate Winston Taylor LLP as counsel. SO ORDERED.. (Signed by Judge Jesse M.
