ORDER AND REASONS granting in part and denying in part 47 Motion for Summary Judgment. The motion for summary judgment is granted as to Plaintiffs' claims against Sheriff Lopinto for: (1) disability-based discrimination and failure to accommodate in violation of Title II of the ADA; (2) disability-based discrimination and failure to accommodate in violation of Section 504 of the Rehabilitation Act; and (3) physical condition-based discrimination in violation of Article I, Section 12 of the Louisiana Constitution, as set forth herein. The motion for summary judgment is denied as to Plaintiffs' claim against Sheriff Lopinto for negligent infliction of emotional distress.
