Order on Motion for Reconsideration
ORDER denying 15 : Plaintiffs report 15 that Defendant Urazbadalov has authorized Mr. Harfenist, an attorney located in the United States, to accept service on his behalf. Nevertheless, they still seek 15 , 16 an order permitting alternative service on Mr. Urazbadalov pursuant to Federal Rule of Civil Procedure 4(f). Because the proposed method of service will be effected within the United States, and because service through an authorized agent is one of the traditional means of service expressly contemplated by Federal Rule of Civil Procedure 4(e)(2)(C), the Court's permission to serve by alternative means pursuant to Rule 4(f)(3) is unnecessary. See, e.g., Spin Master, Ltd. v. Aomore-US, 23-CV-7099, 2024 WL 3030405, at *7 (S.D.N.Y. June 17, 2024) ("[S]ervice under Rule 4(f) must be completed abroad. The text of Rule 4(f) makes clear that Plaintiff can only avail itself of the Rule if service would occur abroad and not within any judicial district of the United States."); Convergen Energy LLC v. Brooks, 20-CV-3746, 2020 WL 4038353, at **7-9 (S.D.N.Y. July 17, 2020) ("The language of the Federal Rules is clear, and that language does not permit the Court to order alternative service at a place outside any judicial district of the United States when the service would be made in a judicial district of the United States.") Accordingly, Plaintiff's motion 15 is DENIED without prejudice. Plaintiffs are directed to serve Defendant Urazbadalov through his authorized agent, Mr. Harfenist, pursuant to the agreement between the parties. So Ordered by Magistrate Judge Seth D. Eichenholtz on 9/11/2026. (NRH)
