DOCKET TEXT ORDER granting 194 GAF's Motion for Leave to File Sealed Document; granting 199 EagleView's Sealed Motion for Leave to File Sealed Document. These motions seek to seal (1) portions of GAF's 192 Short Form Motion to Compel Plaintiffs to Admit or Deny Requests for Admission Nos. 11-15 which quote from or describe terms of the Verisk settlement agreement, and (2) Exhibits A and B to the supporting 193 Declaration of Edward L. Tulin, which are conferral emails and EagleView's discovery responses that also quote from or describe terms of the Verisk settlement agreement. The court has previously ruled that the Verisk settlement agreement and documents quoting from it and describing its terms warrant sealing at this stage to protect EagleView and nonparty Verisk's confidential business information. (See Doc. No. 267 .) For the same reasons, and because the public interest in access is minimal here where GAF's discovery motion was later withdrawn, (see Doc. No. 198 ), the motions to seal are granted and the documents at issue (Doc. No. 195 including attachments) shall remain sealed until otherwise ordered. Signed by Magistrate Judge Daphne A. Pursuant to Rule 37(a)(5)(B) of the Federal Rules of Civil Procedure, the court declines to award expenses to Nearmap because EagleView's position in the motion to compel and objection was substantially justified.
