MEMO ENDORSEMENT on re: 140 Letter filed by Elizabeth Reyes, G. T. ENDORSEMENT: Plaintiff's counsel states that the federal tort claims act provides for a 25% fee. That is incorrect; the statute cited by plaintiff's counsel provides for a maximum fee of 25%. For this reason, plaintiff should submit a revised proposed order that calculates fees based on the table provided in plaintiff's settlement agreement, and the methodology provided in that agreement, namely that fees are calculated based on the sum recovered subject to various deductions (for disbursements, etc.).
