ORDER GRANTING MOTION TO COMPEL granting 54 Motion to Compel. Plaintiff having declined to oppose defendant's motion and having placed his alleged psychological and emotional injury in controversy, the Court finds that there is good cause fo r a Rule 35(a)(1) mental examination to determine the existence and extent of plaintiffs asserted injury. Defendant's motion to compel plaintiff to submit to such an examination (Dkt 54) accordingly is granted. Plaintiff shall submit to such a n examination to be performed by Dr. Elie Aoun at Dr. Aoun's office - 90 Broad Street, Suite 1009, New York, NY 10004 - on a date and at a time that is mutually agreeable to the parties. The scope of the examination shall be limited to "the psychological and emotional distress [plaintiff] claims to have suffered from the alleged drugging/sexual assault, as well as other sources of psychological and emotional distress in [p]laintiffs life."
