Pre Motion Conference ~Util - Set Deadlines/Hearings
MINUTE ENTRY AND ORDER: A pre-motion conference was held on July 30, 2026 before Magistrate Judge Peggy Kuo by video. John W. Hermina, Esq. appeared on behalf of Plaintiffs, of whom the following were present: Plaintiff Perfect Wireless Two LLC's representative Atef Genidy; Plaintiff Kal Electronics Inc.'s representative Laiqur Rehman; Plaintiff Reemas Fashion, Inc.'s representatives Hasan Ijaz and Syed Pasha; Plaintiff Alpha Cellphone Plus, Inc.'s representative Jeanne Liriano; Plaintiff Making Foods, Inc.'s representative Ronnie Chen; Plaintiff Mainestream Wireless Inc.'s representative Dan Nemphos; Plaintiff Mobile Media Passaic LLC's representative Sufian Yassin; Plaintiff Dreams of Field LLC's representative Matt Field. Joseph Dowdy, Esq. appeared on behalf of Defendants Arch Telecom Inc. and Arch Telecom of NY, Inc. (the "Arch" Defendants). Brian Bank, Esq. and Mardeline Cruz, Esq. appeared on behalf of Defendant Portables Choice Group LLC. Student interns Brandon Zitsch and Munyu Njoya were also present.
The parties were heard on Plaintiffs' request 84 for leave to file a Motion for Relief under Federal Rule of Civil Procedure 60(b)(2) and for Leave to Amend under Rule 15(a)(2). Plaintiffs are directed to file their opening brief by September 28, 2026. Plaintiffs' opening brief must, in addition to presenting factual and legal bases for granting their motions, (1) attach a proposed third amended complaint, (2) explain the differences between the proposed third amended complaint and the Second Amended Complaint, (3) provide a legal basis for reviving any claims that were already dismissed by the Court, (4) explain any differences between the proposed third amended complaint and the complaint filed by Plaintiffs in Nassau County Supreme Court, Sunshine Wireless of Long Island Inc. et al. v. T-Mobile USA, Inc., Index No. 610149/2026, [85-3], and (5) provide a legal basis for permitting the filing of a pleading in this Court which pleads the same or substantially similar claims as those already filed in state court. Defendants are directed to file their opposition brief by October 28, 2026. Plaintiffs are directed to file their reply brief by November 9, 2026.
