ELECTRONIC ORDER: In addition to the deadlines in this Court's prior scheduling order, the Court ORDERS that, starting on September 20, 2026, and continuing through the duration of trial, the party presenting evidence the following day must e-mail all counsel and the Court (kevin_frye@txnd.uscourts.gov and jonathan_voos@txnd.uscourts.gov) by 6:00 PM saying what (1) witnesses it intends to take up, (2) exhibits it intends to cover, and (3) demonstratives it intends to use the following day. The Court further ORDERS that the opposing side e-mail all counsel and the Court by 8:00 PM the same day specifying what, if any, objections it has to those exhibits or demonstratives. Each objection shall contain the concise written basis for the objection with a citation to the relevant authority. Explanations should be in plain English, and a mere citation to a rule number is insufficient. The Court will rule on those objections at 8:30 AM the next morning, time permitting, or at sidebars throughout trial. Additionally, the Court ORDERS the plaintiff to submit to the Court a joint exhibit list with fields for (1) exhibit numbers, (2) exhibit descriptions, (3) witness, and (4) exhibit dates by 6:00 PM on September 20, 2026.
