ORDER Re Defendant's Emergency Motion to Late File Statement of Material Facts (Doc. 130 ): The Court notes that Defendant's proposed statement of material facts is substantively identical to the background facts provided in Defendant's memorandum in support of its motion for summary judgment, which are each supported by specific citations to the record. Further, although Plaintiffs claim prejudice, they do not identify any additional fact in the proposed document which they have not already affirmed or denied in their previous response. The Court thus finds Defendant is in substantive compliance with the relevant case management procedures and Plaintiffs will not be prejudiced by what amounts to minor formatting edits. Accordingly, Defendant's Emergency Motion to Late File (Doc. 130 ) is GRANTED. Defendant shall file its Statement of Material Facts on the docket instanter.
