Minute Order Order on Stipulation
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 3/4/2026.
Re: 62 Stipulation to Extend Deadline to File Pretrial Order.
The parties' stipulation indicates that one of their reasons for extending the joint pretrial order deadline is that they wish to conduct a deposition. However, the discovery deadline passed on December 29, 2025, yet the parties do not seek to reopen that deadline to conduct the deposition. To the extent that the parties seek to conduct this deposition outside of the discovery period, they must also show good cause and excusable neglect to reopen discovery for that purpose. Fed. R. Civ. P. 16(b)(4); LR 26-3. Because they do not do so in the instant stipulation, the Court DENIES it without prejudice.
IT IS SO ORDERED.
