Order on Motion for Discovery
TEXT ORDER - On June 17, 2026, the Court heard argument on the several discovery disputes set forth in the parties' April 23 and June 10, 2026 joint letters. [D.E. 18 , 21 ]. For the reasons stated on the record during that hearing, the Court rules as follows: (1) Plaintiff shall forthwith deliver to Defendant the two revised, signed HIPPA authorizations identified during the hearing; (2) Plaintiff shall review and produce to Defendant all documents in his possession, custody, or control that are responsive to any of Defendant's document demands; (3) by his agreement, Plaintiff shall produce to Defendant his 2024 and 2025 filed tax returns (or invoke any applicable privilege); (4) Plaintiff shall produce to Defendant his Facebook posts from August 2024 to the present; (5) Defendant's requests for supplemental responses to certain interrogatories are denied, however; (6) Defendant may depose Plaintiff for an extra hour and Plaintiff may depose any defense witness for an extra hour or allocate that hour across several witnesses with notice to Defendant; (7) Plaintiff shall produce to Defendant job applications, supporting documents, offer letters, and any correspondence rescinding any such offers, since Plaintiff's termination by Defendant; (8) the parties shall meet and confer further concerning Plaintiff's request for production by Defendant of the March 25, 2025 and April 1, 2025 emails discussed in D.E. 21, and attempt to resolve that impasse directly. The parties may file a dispute letter addressing those and other issues on or before July 15, 2026; (9) unless otherwise stated, the production deadline for all of the above is no later than July 31, 2026; (10) before any depositions take place, all counsel shall review the opinion by Judge Shwartz in In re Neurontin Antitrust Litigation, 2011 WL 253434 (D.N.J. January 25, 2011), particularly pages 8 and 9 and the related footnotes, and plan to comport themselves consistent with the guidance therein. This Court will strictly enforce Rule 30 during any deposition in this action; (11) discovery final deadlines, excluding those stated herein, are vacated until further Order; and (12) those deadlines will be revisited during a status conference on October 9, 2026, at 10:00 am, which the parties shall join by dialing 973-437-5535, and entering passcode 407 343 461#.
