Order granting in part 128 , 129 , 130 , and 131 Motions to Dismiss. For the reasons described in the attached ruling, Defendants' Motions to Dismiss the Second Amended Complaint are granted in part and denied in part.
Count One may proceed against Defendants Koskinas, Paulsson, Shaw, Nowinski, Heinmiller, Baker, Restieri, Sullivan, Field, Olivetti, Mengacci, Beauton, Vayan, Clabby, Ornousky, and Lauria. Count Three may proceed against Defendants Paulsson, Shaw, Nowinski, Rest ieri, Sullivan, Field, Olivetti, Mengacci, Beauton, Vayan, Clabby, and Ornousky, but is dismissed against Defendants Heinmiller and Baker. Count Five may proceed against Defendants Paulsson, Shaw, Nowinski, Heinmiller, Restieri, Sullivan, Field, Oli vetti, Mengacci, Beauton, Vayan, Clabby, and Ornousky, but is dismissed against Defendant Baker. Count Seven may proceed against Defendants Restieri, Sullivan, Olivetti, and Mengacci, but is dismissed against Defendants Paulsson, Shaw, Beauton, Vaya n, Clabby, Nowinski, Ornousky, Heimiller, Baker, and Field.
Counts Nine and Ten are dismissed against all Defendants.
Counts Two, Four, Six, and Eight may proceed against the Town of Westport.
Counts Thirteen through Fifteen are dismissed against all Defendants.
Count Sixteen may proceed against Defendants Koskinas and Lauria.
Defendants Frechette and Woods are dismissed from this suit. The Clerk is directed to terminate them from the docket.
As discove ry is scheduled to conclude on October 13, 2026, the Court resets the deadline for the parties to file motions for summary judgment and motions to exclude experts to November 13, 2026.
