TEXT ORDER: On August 10, 2026, the parties filed a 24 Stipulation of Dismissal. The Court denied the stipulation of dismissal because, in part, it did not appear to dismiss Plaintiffs' claims against Defendant Huizhou Bide Technology Co., LTD. (See Text Order dated August 10, 2026). The Court instructed Plaintiffs that, if they wished to dismiss only the claims against the Amazon-related Defendants, they could move to amend their complaint. Plaintiffs have now filed a 26 Agreed Motion for Leave to File First Amended Complaint. Federal Rule of Civil Procedure 15(a)(2) provides two ways for a party to amend its complaint after the time to amend as a matter of course has elapsed: (1) with leave of court, or (2) with the opposing party's consent. Because Defendants have consented to the amendment, the requirements of Rule 15(a)(2) are satisfied. Accordingly, Plaintiffs' 26 Agreed Motion for Leave to File First Amended Complaint is GRANTED. The Clerk is DIRECTED to docket [26-1] as Plaintiffs' First Amended Complaint. Plaintiffs have also filed a 28 proposed order on the docket as a motion. But Civil Local Rule 5.9(B)(2) requires that proposed orders be submitted as attachments to motions. Therefore, the Clerk is DIRECTED to STRIKE Plaintiffs' 28 motion.
