Scheduling Order
ORDER. On 8/14/2026, the Court ordered Defendants and Plaintiffs to file a written statement on or before 8/27/2026 if they opposed Defendants' counsels motion to withdraw at ECF Nos. 54 , 55 , 56 . The parties did not file anything by the deadline. Accordingly, the Court considers the motion to withdraw at ECF No. 54 to be unopposed. A hearing on the motion to withdraw is set for 10/22/2026 at 12:30 PM before Chief Magistrate Judge Vera M. Scanlon via ZoomGov. To gain access to the ZoomGov audio conferencing system, the parties are to dial 1-646-828-7666; enter meeting ID 16121901090 and press the pound key; when asked for a participant ID, press the pound key; and enter passcode 091622 and press the pound key.
Defendants are on notice that if the motion to withdraw is granted, the individual Defendant may represent himself but the corporate Defendant may only appear by counsel. If counsel does not appear, a default judgment may be entered. Defendants are also on notice that the Court is unlikely to grant a significant discovery stay while Defendants retain new counsel given the age of the case and the pendency of the motion to withdraw since mid-August 2026.
Defendants' counsel is directed to serve this order on each Defendant by 10/7/2026 and to file proof of service by 10/9/2026.
Discovery and dispositive motion practice are stayed pending the resolution of the motion to withdraw.
