MINUTE entry before the Honorable Lindsay C. Jenkins: The Fund's motion for summary judgment as to the Summit 48 is granted in part and denied in part. It is granted as to Count I, III, V, and VII as to the Summit entities and denied as to Count IX. Defendants Chad and Jodi Boucher's motion for summary judgment 45 is likewise denied. See the attached order for further details. As to the remaining claims: 1. The court is prepared to grant summary judgment for the Fund on Counts III, V, and VII against the Alsip, Northern Illinois, and Joliet Defendants, but because the Fund did not move for summary judgment against them, the court provides the Alsip, Northern Illinois, and Joliet Defendants until August 10, 2026 to file a statement on the docket if they believe that collateral estoppel applies uniquely to the Summit entities, bearing in mind the court's order and Rule 11. If nothing is filed by that date, then the court will also enter summary judgment against those Defendants on Counts III, V, and VII. 2. As to Counts II, IV, and VI, and VIII (alter ego liability), the court has resolved the primary claims on collateral estoppel grounds, so it does not reach the merits of these claims. 3. Count IX is the claim that remains for trial. To facilitate scheduling a jury trial, the court advises the parties that it has availability for trial in the first quarter of 2027. The parties are to confer and agree upon two mutually agreeable trial dates in this time frame. By August 17, 2026, the parties are to jointly file a statement on the docket that identifies their mutually agreeable trial dates, along with an estimate of the combined number of trial days necessary to try the case so that the court can set a firm trial date. That August 17 statement should also confirm that the Fund is prepared to dismiss Counts II, IV, and VI, and VIII in light of this order. Mailed notice. (jlj, ) (Entered: 08/03/2026)
