Order on Motion for Extension of Time to File Scheduling Order
ORDER granting 122 : Plaintiff's motion for an extension of time to file its request for costs associated with the recent adjournment of the trial is GRANTED. Plaintiff shall file its motion on or before 7/20/2026. The Court will hold a telephone status conference on 7/15/2026 @ 10:30 AM. To access this conference, the parties are directed to call the number 571-353-2301, enter the call ID number 154-822-487 and then press #. Mr. Beyda is required to participate in this call and any counsel who intends to represent him should also join the call.
Plaintiff reports that Mr. Rownd no longer intends to represent Mr. Beyda in this action. As no attorney has appeared for Mr. Beyda, he must proceed pro se until such time as an attorney appears on his behalf. While he is proceeding pro se, Mr. Beyda must confer directly with Plaintiff's counsel about matters related to this case. Mr. Beyda, or an attorney who is representing him, is directed to contact counsel for Plaintiff on or before 7/13/2026 to address the outstanding issues about which the parties must confer.
Mr. Beyda is further directed to send an e-mail to Eichenholtz_Chambers@nyed.uscourts.gov by 7/13/2026 @ 5:00 PM, providing the Court with a mailing address where he can regularly receive correspondence, as well as a telephone number at which he may be reached while he is proceeding pro se. Counsel for Plaintiff should be copied on the e-mail. The Court will provide Defendant with a form to consent to receive electronic notification of orders issued in this case. If Mr. Beyda intends to consent, he should in his e-mail message give Chambers permission to add his e-mail address to the docket sheet.
Finally, Mr. Beyda is reminded that the Court will not adjourn the date of the forthcoming trial. The time provided by the Court is sufficient for Defendant to find new counsel and allow that counsel to prepare for trial, or for Mr. Beyda prepare to represent himself at the trial if necessary. If he is unable to find new counsel with enough time for that counsel to prepare, he will be required to proceed to trial without an attorney.
Counsel for Plaintiff is respectfully requested to promptly forward this order to Mr. Grunsfeld and Mr. Rownd to ask that one of them communicate this order to Mr. Beyda sometime today. Mr. Grunsfeld is respectfully requested to file a brief letter on the docket confirming that either he or Mr. Rownd has provided Defendant with a copy of this order.
