ORDER: The parties are directed to submit letter briefs to the Court no later than 5:00 p.m. on September 28, 2026, directed to the impact of the Court's April 2, 2026 Opinion and Order on Abel's conditional motion for summary judgment. Su ch letter briefs shall address whether conditional summary judgment is no longer appropriate given the conclusion of Lively's claims against Abel and whether the motion should be dismissed without prejudice to the filing of a new motion based on the current status of the case for the full relief sought in Abel's second cause of action in her third-party complaint against Jonesworks.
