District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. At the charge conference the Court resolved all the objections except one regarding the unreasonable use defense. After consideration of the various arguments the Court has revised somewhat the statement of elements of the unreasonable use defense and corresponding special verdict questions. The final instructions and verdict form are attached. The Motion for Supplemental Designations (#112) was allowed in open court without objection. The Motion for Directed Verdict (#116) was allowed as to punitive damages in open court today, without objection from Plaintiff. The remainder of that motion remains under advisement.
