Order on Motion to Dismiss/Lack of Jurisdiction
TEXT ORDER. Currently pending before the Court is Plaintiff's Motion to Dismiss Defendants' Counterclaims. See ECF No. 17 . On June 8, 2026, the Court granted Defendants' Motion to for Leave to Amend, and on June 22, 2026, Defendants filed their Amended Answer. See ECF Nos. 29 , 30 . As a general rule, "an amended pleading ordinarily supersedes the original and renders it of no legal effect." See Young v. City of Mount Ranier, 238 F.3d 567, 573 (4th Cir. 2001) (citations omitted). "As a result, motions directed at the superseded pleading generally are to be denied as moot." Grubbs v. Wal-Mart Stores, Inc., No. 1:19-CV-02229-JMC, 2020 WL 2769032, at *1 (D.S.C. May 28, 2020) (citations omitted). Accordingly, because the original Answer was superseded by Defendants' Amended Answer, the Court finds as moot 17 Plaintiff's Motion to Dismiss. Signed by Honorable Donald C Coggins, Jr on 6/23/26.(alew)
