TEXT ORDER: The Court is in receipt of a request from defense counsel that tomorrow's conference be held virtually because he arranged to be at a deposition at the same time and is unavailable to attend, despite this Court's conference having been scheduled in May of 2026. (Dkt. No. 29 ). The letter fails to note the position of Plaintiff in violation of this Court's prior Order (Dkt. No. 28 ) and Case Management Order. The parties have also failed, without explanation, to abide by this Court's multiple Orders to file a joint proposed amended scheduling order. (Dkt. Nos. 21 , 25 , and 28 ). The conference is adjourned until 9/16/26 at 11:30 a.m. Due to the late notice of the adjournment request, counsel for Defendant shall advise Plaintiff by telephone and email on 8/19/2026 of the adjournment. At the next conference, counsel and all parties shall appear in-person to address the parties' repeated lack of compliance with the Orders of this Court. Counsel for Defendant shall certify no later than 8/26/2026 that he served a copy of this Order on the Defendant. So Ordered by Magistrate Judge Cari Fais on 8/19/2026. (qa, )
