MINUTE ORDER (TEXT Only): On May 16, 2024, the Court convened an informal discovery dispute conference to discuss the extension of Plaintiff's July 24, 2024 deposition per the parties' request. (Docs. 49 - 51 .) At the conference, counsel for Plaintiff informed the Court that Plaintiff did not stipulate to the Court's informal resolution of the matter. The Court provided guidance pursuant to Federal Rule of Civil Procedure 30(d)(1) on duration of depositions, which provides that unless "otherwise stipulated or ordered by the court, a deposition is limited to one day of 7 hours," though "The court must allow additional time consistent with Rule 26(b)(1) and (2) if needed to fairly examine the deponent or if the deponent, another person, or any other circumstance impedes or delays the examination." Fed. R. Civ. P. 30(d)(1). Plaintiff's counsel contended that Plaintiff could sit for a full day of depositions and that Defendant should first attempt to take Plaintiff's deposition before requesting further time, pursuant to Federal Rule 30(a)(2). Defendant argued that given Plaintiff's medical condition, Plaintiff would be unlikely to give effective testimony after approximately four hours, which would necessitate an additional day of deposition and modification of the scheduling order. The Court noted that the parties could file formal discovery motions, could attempt to take Plaintiff's deposition and then move for an extension of the deposition if necessary, or could stipulate to the Court's informal discovery dispute resolution process during or following the deposition. The Court directed the parties to meet and confer on arranging Plaintiff's deposition to ensure effective testimony. Minute order signed by Magistrate Judge Barbara A. McAuliffe on 5/16/2024.
