TEXT ORDER granting in part and denying in part 146 Motion to Dismiss for Lack of Jurisdiction Counts 3 and 4 of Plaintiff's Complaint filed by State of Rhode Island, Department of Human Services, Office of Veterans Affairs: Defendants' Motion to Dismiss Counts 3 and 4 is GRANTED IN PART AND DENIED IN PART. By agreement, Count 3 concerning FEPA is dismissed. As to Count 4 (RICRA), it is neither efficient nor proper for the Court to proceed with litigating the RICRA count when the 1st Circuit has a certified question before the R.I. Supreme Court (Parente v. Lefebvre, 122 F. 4th 457) on this very issue is a RICRA claim in federal court barred by the Eleventh Amendment).
