ORDER RE JOINT STIPULATION RE CONTINUANCE OF TRIAL AND RELATED DATES PENDING SETTLEMENT by Magistrate Judge Autumn D. Spaeth: The Court, having reviewed the Joint Stipulation to Continue Trial and Related Dates Pending Settlement, and good cause appearing therefore, hereby ORDERS as follows: 1. The Joint Stipulation 61 is APPROVED. 2. This action is STAYED pending further order of the Court for the purpose of allowing the Parties to finalize their settlement. 3. The Final Pretrial Conference presently scheduled for July 8, 2026, is VACATED. 4. The Jury Trial presently scheduled to commence on August 4, 2026, is VACATED. 5. The Parties shall file a Joint Status Report every thirty (30) days from the date of this Order advising the Court of the status of the settlement, unless otherwise ordered by the Court. 6. An Order to Show Cause re: Status of Settlement is set for September 30, 2026 at 10:00 a.m. 7. If the settlement has been fully executed and performed before the OSC date, the Parties shall promptly file either: (a) a Stipulation for Dismissal pursuant to Rule 41(a) of the Federal Rules of Civil Procedure; or (b) a Joint Request for Dismissal and Vacatur of the OSC. 8. If the settlement is not completed by the OSC hearing, the Parties shall appear and be prepared to advise the Court regarding the status of the settlement and whether new case management dates should be established.
