Order on Motion for Extension of Time
ORDER: The Court is inclined to deny as moot Synergy Construction's Motion to Dismiss, Doc. 133 , in view of the identical argument raised in Defendant' Motion for Summary Judgment, which the Court shall address on its merits once it is fully briefed. To the extent any of any Party object to, the Court ORDERS the Party to file a notice, within FIVE DAYS from the entry of this Order, stating the grounds for the objection. And as discussed above, the Court LIFTS Synergy Construction's default, considers its Motion to Dismiss to be timely filed, and GRANTS nunc pro tunc Plaintiffs' Motion for Extension of Time to File a Response. Doc. 134 . The Court ORDERS the Parties to file a notice, within FIVE DAYS from the entry of this Order, advising the Court of the status of mediation or any other settlement efforts in which they have or remain engaged.
