MEMORANDUM OPINION AND ORDER re: 111 FIRST MOTION for Summary Judgment . filed by Matthew Gross, Newsela, Inc..For the reasons explained above, Defendants' motion for summary judgment is granted in part and denied in part. The mo tion is granted as to Plaintiff's claim that Defendants failed to accommodate her third, fourth, fifth, sixth, and seventh accommodation requests (Counts 2, 4, and 6); as to Plaintiff's claim that Defendants failed to engage in an interacti ve process under the ADA and NYHSRL (Counts 2, 4, and 6); and as to Plaintiff's retaliatory OSTENFELD MSJ SEPTEMBER 15, 2026 38 hostile work environment claim under the FMLA (Count 1). The motion is denied with respect to all of Plaintiff' s other claims. Docket Entry No. 111 is resolved. A Final Pretrial Conference is hereby scheduled for Friday, February 19, 2027, and the parties are directed to consult, exchange documents and make submissions in accordance with the Pretrial Scheduli ng Order filed contemporaneously herewith. The parties are further directed to arrange promptly for a settlement conference with Magistrate Judge Wang, to whom this case will be referred for that purpose, and to file a joint status report, including their estimate of the amount of time that will be required for any contemplated trial, by Tuesday, December 21, 2026. ORDER re 30 : The parties attached a stipulation of dismissal in their motion for settlement approval pursuant to Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015). (See ECF 30-1.) However, as stated at the 01/30/2025 Motion Hearing, the stipulation of dismissal was not signed and executed by defense counsel. (See Tr. 3:13-17.) Accordingly, by 04/10/2026, defense counsel shall sign and file a revised stipulation of dismissal containing the required signatures pursuant to Federal Rule of Civil Procedure 41.
