District Judge Margaret R. Guzman: ELECTRONIC ORDER entered. The Court hereby GRANTS Plaintiff's Motion to Amend their complaint 11 . Federal Rule of Civil Procedure 15(a)(2) provides that a "court should freely give leave [to amend a pleading] when justice so requires." Fed. R. Civ. P. 15(a)(2). A court "enjoys significant latitude in deciding whether to grant leave to amend." U.S. ex rel. Gagne v. City of Worcester, 565 F.3d 40, 48 (1st Cir. 2009) (citations omitted). Grounds for denial include "undue delay, bad faith or dilatory motive... undue prejudice to the opposing party... [and] futility of amendment." Foman v. Davis, 371 U.S. 178, 182 (1962). The Court does not find these grounds present in this case, and therefore, will GRANT the Plaintiff's Motion to Amend their complaint 11 . Accordingly, the pending motion to dismiss related to the now non-operative complaint will be denied as moot 7 . Plaintiff shall file their Amended Complaint, 11 Ex. A, as a separate docket entry and shall promptly serve any newly added defendants in accordance with the Federal Rules of Civil Procedure. (LB)
