PAPERLESS ORDER: The Court has reviewed 33 the parties' Joint Motion for Leave to Take Video Deposition to Preserve Trial Testimony of Non-Retained Treating Physician Dr. Neil Ghany. The parties represent that the video deposition is scheduled to take place on June 15, 2026, and request, out of an abundance of caution, a limited extension through June 22, 2026, solely to ensure that the deposition can be completed and recorded in the event of an unforeseen medical emergency or technical disruption. The motion is GRANTED to the extent that, as a discovery matter, the parties may take the video deposition of Dr. Neil Ghany on or before June 22, 2026. Nothing in this Order modifies any other deadline set forth by the presiding District Judge. Moreover, nothing in this Order should be construed as a ruling that any portion of the deposition will be admissible at trial or may be used in lieu of live testimony. Any issues regarding the use of the video deposition at trial shall be presented to and resolved by the presiding District Judge, as appropriate. Signed by Magistrate Judge Ryon M.
