STIPULATION TO AMEND ANSWER AND AFFIRMATIVE DEFENSES: The parties, by and through their undersigned counsel, stipulate and consent to granting Defendant Scottsdale Insurance Company ("Scottsdale") leave to amend its Answer and Affirmative Defenses [ECF No. 15] to withdraw the following affirmative defenses set forth in Scottsdale's Answer: First Affirmative Defense, Third Affirmative Defense, Fourth Affirmative Defense, Fifth Affirmative Defense, Sixth Affirmative Defense, Eighth Affirmative Defense, Tenth Affirmative Defense, Twelfth Affirmative Defense, Thirteenth Affirmative Defense, Sixteenth Affirmative Defense, and Twenty-First Affirmative Defense. To the extent the above identified affirmative defenses overlap with Scottsdale's remaining Affirmative Defenses, the parties agree that Scottsdale's withdrawal of the above-identified defenses does not limit, forfeit, or waive any aspect of Scottsdale's remaining affirmative defenses, which Scottsdale fully reserves. The Amended Answer and Affirmative Defenses is attached as Exhibit A. Application GRANTED. By not later than Thursday, May 9, 2024, Defendant must file its amended answer as a separate docket entry.
