TEXT ORDER: As the parties are aware, on August 12, 2026, the Court conducted a hearing during which it granted Plaintiff's Motion to Compel Discovery. In its Motion, Plaintiff sought an award of its reasonable attorneys' fees and expenses incurred in bringing the Motion to Compel, which, according to Federal Rule of Civil Procedure 37(a)(5)(A) "must" be imposed absent the applicability of one of three limited exceptions. Local Civil Rule 54.2(a) ordinarily contemplates a separate motion for attorneys' fees and expenses supported by an affidavit and contemporaneous time records. However, Local Civil Rule 54.2(c) explicitly authorizes exceptions to the normal documentation requirements under "appropriate circumstances, including but not limited to those where counsel fees are sought as sanctions in connection with discovery and other pretrial motions" such as the matter presented here. Under the circumstances of this case, the Court hereby dispenses of the need for a formal fee motion under Local Civil Rule 54.2(a). In lieu of such motion practice, Plaintiff is directed to file a fee application that includes an affidavit regarding attorneys' fees and expenses/disbursements incurred in connection with the Motion to Compel, including an explanation of relevant timekeepers and billing practices with supporting billing records. To not interfere with the other deadlines already set during the August 12, 2026 hearing, Plaintiff shall file its fee application by October 23, 2026. Defendant's opposition, if any, shall be filed by November 6, 2026. No reply is permitted absent prior approval from the Court. So Ordered by Magistrate Judge Tonianne J. Bongiovanni on 9/10/2026.
