For the foregoing reasons, the First Amended Complaint should be dismissed with leave to amend, except that Medina's abandoned disability and retaliation claims (Counts IV, V, VI, IX) should be dismissed with prejudice. To the extent not addressed above, the Court has considered the parties arguments and finds them to be either moot or without merit. Objections to R&R due by 9/1/2026.
