ORDER REGARDING ESTABLISHMENT OF POOLED SPECIAL NEEDS TRUST by Judge Michelle Williams Court. Conservators are DIRECTED to execute the joinder agreement required by the Special Needs Trust Foundation to establish Mr. Ponce's sub-account in the pooled trust, as well as all other necessary documents to implement the Court's orders. Bond and accounting requirements are WAIVED as to the Special Needs Trust Foundation. The net settlement proceeds to be ordered into the pooled trust sub-account are intended to establish a supplemental fund and SHALL NOT displace any public financial assistance for which Mr. Ponce is otherwise eligible. Upon Mr. Ponce's death, all remaining funds in the pooled trust sub-account, to the extent not retained by the trust, SHALL be used to reimburse the State of California for medical assistance paid on behalf of Mr. Ponce during his lifetime.
