MINUTES for proceedings held before Magistrate Judge Kayla D McClusky: SCHEDULING CONFERENCE held on 9/30/2026. Participating by telephone were: William Robert Coenen, III, Michael Louis Heaton on behalf of Plaintiff John Poindexter; Paul M Adkins on behalf of Comstock Oil & Gas Louisiana L L C; Parker Wayne Maxwell on behalf of Louisiana Gas Development Corp; and Philip Michael Wood on behalf of Occidental Chemical Corp. Because of the unique issues with this type of case, after discussion, I instructed counsel to file a joint proposed case management order no later than November 20, 2026. Once the proposed order is filed, I will consult with Judge Edwards regarding trial dates in 2028. I also indicated that I would circulate those proposed dates via email and then, assuming that the proposed deadlines in the case management order are acceptable, I will issue the case management/scheduling order once a trial date is confirmed. Additionally, Plaintiff's counsel has not yet been able to serve Defendant O'Brien. A notice of intent to dismiss O'Brien issued on September 8, 2026, if service is not made within the next 90 days. If Plaintiff is unable to effect service prior to the anticipated dismissal date, counsel will file either a motion for extension of time or will move to voluntarily dismiss without prejudice.
