Judge Richard G. Stearns: ELECTRONIC ORDER entered granting in part and denying in part 49 Motion to Compel discovery responses. The court agrees that plaintiffs are due some class discovery, but their requests are overly broad. The production will be limited to information relevant to their claims which are for withheld tips and automatic 30-minute employee break deductions. The statute of limitations on FMLA claims is up to three years (for intentional violations). Accordingly, defendants Joest LLC, and Joseph DeQuattro will produce the names and contact information for employees in this judicial district that were subject to withheld tips and 30-minute employee break deductions from February 2, 2023, to the present, to the extent that the documentation exists. With regard to the remaining discovery requests, defendants will respond, subject to appropriate objections, with regard to the representative plaintiffs, Yvonne Mezokk and Peter Zecca. (MZ)
