ORDER GRANTING IN PART AND DENYING IN PART DEFENDANTS' MOTION FOR SUMMARY JUDGMENT AND PLAINTIFF'S CROSS-MOTION FOR SUMMARY JUDGMENT 49 , 51 , 52 , 72 by Judge Hernan D. Vera. For the foregoing reasons, Defendants' Motion for Summary Judgment is granted, in part, and denied, in part. The Court grants summary judgment on Ramirez's seventh claim for intentional infliction of emotional distress, but denies summary judgment in its entirety on all other claims and issues. Ramirez's Motion for Summary Judgment is also granted, in part, and denied, in part. The Court grants summary judgment on Ramirez's sixth claim for strict liability under California Civil Code section 3342, but denies summary judgment in its entirety on all other claims and issues.
