MEMORANDUM AND ORDER: For the reasons stated in the attached Memorandum and Order, Plaintiff's motion 27 for reconsideration is DENIED and Defendants' motion 25 26 to dismiss Plaintiff's Complaint is GRANTED without prejudice. That said, Plaintiff's motion 32 to amend her complaint to substitute Marcia T. Dunn ("Trustee Dunn") as the proper party plaintiff is GRANTED. Should Trustee Dunn wish to pursue Plaintiff's claim, Plaintiff shall file within thirty (30) days of the entry of this order an amended complaint substituting Trustee Dunn as the plaintiff in this action.
