EO: On 10/2/2026, Respondent United States of America ("Government") filed [ECF 9 ] Motion for Summary Denial of Petition to Quash and for Enforcement of IRS Summonses ("Motion"). ECF No. 9. The Court construes the Motion as the Government's response and cross-motion to Petitioner KH Makaha LLC's ("Petitioner") [ECF 1 ] Petition to Quash Third-Party Summonses Issued to First Hawaiian Bank, Central Pacific Bank, and Commonwealth Business Bank Under 26 U.S.C. 7609(b)(2) ("Petition"). ECF Nos. 1, 5 & 9. Consistent with Local Rule 7.7, the Court schedules the Motion for hearing on 10/23/2026 at 11:30 a.m. before Magistrate Judge Trader contemporaneous with the hearing on the Petition. ECF No. 5; Local Rules of Practice for the United States District Court for the District of Hawaii 7.7. Both hearings will be conducted by Video Teleconference ("VTC"). The Courtroom Manager will provide the VTC information by email.Briefing shall be as follows:
a. Petitioner's reply in support of the Petition and/or opposition to the Motion is due 10/14/2026.b. Government's reply in support of the Motion is due 10/21/2026.
