   ORDER: On June 20, 2023, Petitioner Mei Guo filed the instant Petition for a Writ of Mandamus, seeking an order compelling Bankruptcy Judge Manning to dissolve the prejudgment remedy and preliminary injunction entered against Petitioner on March 17, 2023 in HK Int'l Funds Investments (USA) Ltd., LLC v. Kwok, et al., Case No. 3:22-AP-5003 (JAM) (the "Underlying Proceeding"). Since the Petition was filed, this Court, in a separate appeal arising from the Underlying Proceeding, affirmed the Bankruptcy Court's ensuing summary judgment decision therein, to wit, that HK International Funds Investments (USA) Limited, LLC ("HK") was an alter ego of the Individual Debtor Ho Wan Kwok (the "Debtor") and that HK's assets therefore belonged to the Debtor's Estate. See In re Kwok, No. 3:23-CV-458 (KAD), at ECF No. 60. Thereafter, the Second Circuit affirmed this Court's Order. See id. at ECF No. 64. In connection with HK's Second Circuit appeal, the Trustee agreed to dismiss any remaining claims asserted in the Underlying Proceeding, thus making the Bankruptcy Court's summary judgment decision an appealable final order. See id. Thus, it appearing that the Underlying Proceeding is fully and completely resolved, the Court is of the view that the instant Petition is moot, insofar as there is no further relief that this Court can afford Petitioner. If Petitioner disagrees, she shall file a Notice on or before August 7, 2026, advising the Court as to why the Petition should not be denied as moot. If no such Notice is filed, the Clerk of Court is directed to close this case on August 10, 2026. It is so ordered. Signed by Judge Kari A. Dooley on July 29, 2026. (AS)
