STIPULATED ORDER REGARDING DISCOVERY OF ELECTRONICALLY STORED INFORMATION. This Order supplements the provisions of Federal Rules of Civil Procedure 26 and 34 concerning discovery of electronically stored information ("EST"), the Local Rules for the United States District Court for the Southern District of New York (the "Local Rules"), and any other applicable orders and rules. This Order does not displace Federal Rules of Civil Procedure 26 or 34 or diminish a party's obligations to search for, collect, and produce discoverable information that is kept in the ordinary course as ESL This Order shall not be interpreted to require production of irrelevant information or disclosures beyond those required by the Federal Rules of Civil Procedure or the Local Rules. To the extent a Party reasonably believes that compliance with this Order imposes an undue burden with respect to any protocol or source, the parties shall promptly confer in an effort to resolve the issue. Nothing in this Order is intended to, nor does, waive any objections to discovery or admissibility, or any other privileges or immunities or, except as specifically provided herein, impose obligations different than those contained in the Federal Rules of Civil Procedure and/or the Federal Rules of Evidence. The parties recognize that additional issues or unforeseen circumstances may arise in the course of discovery, and nothing in this Order is intended to, nor does, restrict the ability of any party to request additional information or seek additional relief from the Court.
