   ORDER: The Court is in receipt of Plaintiff's motion 199 to restore the action, set a new trial date, and vacate the April 28, 2014 remittitur order. This is Plaintiff's third time making this motion seeking this relief. By order dated September 14, 2016, the Court denied 190 Plaintiff's first motion seeking this relief. On November 29, 2017, the Second Circuit affirmed 193 the Court's denial of Plaintiff's first motion. Plaintiff then filed his second motion 194 on January 25, 2018, which the Court denied 195 on January 29, 2018. As part of its denial, the Court warned Plaintiff that future filings may be enjoined and sanctioned pursuant to 28 U.S.C. § 1927. Following Plaintiff's appeal, the Second Circuit affirmed 197 the Court's denial of Plaintiff's second motion. Plaintiff's instant motion raises no new legal or factual arguments. Instead, Plaintiff only makes conclusory arguments that the Court's prior actions are erroneous. Therefore, for the reasons stated in the Court's prior rulings, the Court DENIES Plaintiff's motion 199 . As explained above, this is Plaintiff's third time making the same motion requesting the same relief after having appealed the denials of his prior motions to the Second Circuit twice before. Plaintiff is warned that future filings of this motion may result in the imposition of sanctions, including an injunction on future filings, against him.
