MINUTE ORDER by Judge Sara E Hill - Before the Court is defendant JJ Nuts, LLC's corporate disclosure statement. [ECF No. 30]. Defendant identifies "AA Equities, LLC" as the sole member of JJ Nuts, LLC, that Jay Amore is the "100% owner" of AA Equities, LLC, and that Jay Amore is a "resident" of New Jersey. The citizenship of LLCs depends on each "member" of the LLC, not each "owner," and where an LLC has another LLC as a member, the citizenship "must be traced through however many layers of partners or members there may be to determine the citizenship of the LLC." [ECF No. 61, at 7-8]. The disclosure form requires identification of "citizenship," not "residence." Residence and citizenship are not the same. Travelers Indemnity Co. of Connecticut v. Brook, No. CIV-23-420-F, 2023 WL 3471447, at *1 (W.D. Okla. May 15, 2023). The Court therefore ORDERS the defendant to file a corrected disclosure statement identifying all members of the LLC and such members' citizenship. Defendant shall file a corrected disclosure statement within seven days of the date this order is entered. Failure to comply with this order may result in sanctions up to and including default judgment/dismissal., setting/resetting deadline(s)/hearing(s): ( Miscellaneous Deadline set for 5/20/2024) (Re: 30 Disclosure Statement (Rule 7.1) ) (This entry is the Official Order of the Court. No document is attached.) (lmc, Chambers)
