Extending Answer Due Deadline
ORDER ON STIPULATION TO EXTEND TIME FOR PLAINTIFF ACTIMIZE INC. TO RESPOND TO COUNTERCLAIM BY 17 DAYS 22 by Judge Mark C. Scarsi: Actimize's deadline to respond to Banner's counterclaim [Dkt. 19] is extended to October 30, 2026. No further extensions will be granted absent an extraordinary showing of good cause presented in a stipulation or request that complies with Initial Standing Order § 4. Should Actimize move to dismiss the counterclaim, Banner shall respond to Actimize's motion to dismiss on or before November 30, 2026. Actimize shall file any reply on or before December 7, 2026. Actimize shall set the hearing date on December 21, 2026, provided that date remains open on the Court's calendar. The motion must state the briefing schedule in the notice.
