Order on Motion for Leave to File Excess Pages
PAPERLESS ORDER. THIS CAUSE came before the Court upon Defendant Sullivan & Cromwell LLP's Unopposed Motion for Leave to File Brief in Excess of Twenty Pages. 651 . Therein, Defendant requests permission to exceed the twenty (20) page limitation set by Local Rule 7.1(c)(2) and "file a forthcoming motion to dismiss no longer than forty pages." Id. at 1. In support of this request, Defendant asserts that the Class Action Complaint filed by Plaintiffs "is seventy-five pages long and contains 301 paragraphs and five counts." Id. Accordingly, Defendant "requests twenty additional pages to adequately place Plaintiffs' factual allegations and legal claims in context and to facilitate efficient resolution of the motion." Id. Plaintiffs do not oppose the relief requested. Id. at 2. UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 651 is GRANTED. In accordance with the Court's prior order assigning page lengths to other motions to dismiss, see (ECF No. 216), Defendant may file a motion to dismiss that is no longer than forty (40) pages. Signed by Judge K. Michael Moore on 5/10/2024. (sdu)
