Order
ORDER instructing entry of default. On August 3rd, this court ordered Defendants to secure new counsel and for said counsel to file an appearance by August 31, or else "Defendants shall be defaulted and judgment enter[ed] against them." ECF No. 39. To date, no legal representative has filed an appearance on Defendants' behalf, and the deadline set by the court has passed. A corporation "may not appear or be permitted to conduct litigation unless represented by counsel." Bravado Intern. Grp. Merch. Servs., Inc. v. Ninna, Inc., 655 F. Supp. 2d 177, 189 (E.D.N.Y. 2009) (citing Shapiro, Berstein & Co. v. Cont'l Record Co., 386 F.2d 426, 427 (2d Cir.1967) (per curiam)). Therefore, "a defendant corporation's failure to comply with a court order to secure counsel constitutes a failure to defend and will subject the party to a default judgment against it." Id. Accordingly, the Clerk of Court is asked, respectfully, to please enter default as to the Defendants. The Plaintiff shall move for default judgment on or before October 5, 2026. It is so ordered.
