The following motions in this matter remain pending: Delta's Motion to Exclude Testimony of John A. Kilpatrick (Dkt. 539 ), Delta's Motion to Exclude Testimony of Richard S. John (Dkt. 540 ), Delta's Motion to Exclude Testimony of Dr. James Wells (Dkt. 541 ), Delta's Motion for Partial Summary Judgment (Dkt. 542 ), Plaintiffs' Motion to Exclude Delta's Expert Christina M. Brunk and Request for a Daubert Hearing (Dkt. 543 ) and Plaintiffs' Motion for Approval of Notice of Class Plaintiffs' Certified Class Action (Dkt. 607 ). On or before June 13, 2024, the parties shall file a joint report stating their collective and/or respective positions as to whether any rulings on any or all of these pending motions should continue to be deferred while further settlement discussions proceed, and if so, the schedule for those discussions.
