Order on Motion for Sanctions
PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiffs' Motion for Sanctions. 34 . Plaintiffs' Motion includes no certificate of conferral. Further, Defendant indicates that there was in fact no conferral between the Parties before Plaintiffs filed their Motion. 35 at 2. Under the local rules, conferral is required before the filing of all motions, other than listed exceptions. S.D. Fla. L.R. 7.1(a)(3). None of these listed exceptions are motions for sanctions. Therefore, Plaintiffs were required to confer with Defendant before filing the instant Motion and failed to do so. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and otherwise being advised of the premises, it is hereby ORDERED AND ADJUDGED that Plaintiffs' Motion 34 is DENIED. Should Plaintiffs seek to file another Motion, they shall first meaningfully confer with Defendant. Further, Plaintiffs shall indicate with specificity why their motion is not mooted for the reasons discussed in Defendant's Response. (ECF No. 35) at 3-4. Signed by Judge K. Michael Moore on 7/24/2026. (hyn)
