TEXT ORDER: After a careful review of the docket in this action, it appears that the entry of default against Defendants Jamison Bell ("Bell") and Marcus Goodwater ("Goodwater") was improperly entered in this case, as the affidavits of default filed by Plaintiff Progressive Northern Insurance Company ("Plaintiff") do not actually support the entry of default. Stated plainly, the affidavits indicate that Defendants Bell and Goodwater were both served in September of 2025 with copies of the summons and complaint in this declaratory judgment action, although it is not clear whether they were served with the initial or the amended complaint. (See ECF No. 36 at 1; ECF No. 37 at 1.) Importantly, Plaintiff filed a second amended complaint and a third amended complaint in October of 2025. In December of 2025, the Court entered a text order explaining that Plaintiff improperly filed its second and third amended complaints without the consent of the opposing parties or leave of Court, but nevertheless granting Plaintiff permission to proceed with its third amended complaint. (ECF No. 30.) Despite this, it does not appear from the record that Plaintiff ever served Defendants Bell and Goodwater with the third amended complaint, which was the operative pleading when Plaintiff requested entry of default as to these Defendants in March of 2026 (and which remains the operating pleading at this time). Furthermore, because the record, at least at this time, does not support the entry of default against these Defendants, it likewise does not support default judgments against these Defendants. Accordingly, the Court hereby denies Plaintiff's motions for default judgment as to Defendants Bell and Goodwater (ECF Nos. 41, 42), which are actually captioned as motions for damages hearings even though no damages are sought in this matter. The Court also directs the Clerk of Court to vacate the entry of default as to Bell and Goodwater (ECF No. 40), entered on March 13, 2026, as improvidently granted. IT IS SO ORDERED.
