Order ~Util - Set/Reset Deadlines
TEXT ORDER: The docket reflects that Defendant Malkit Singh has not been served. Because this action was removed on April 9, 2026, and Singh was already a named defendant, Plaintiffs were required to serve him by July 8, 2026, and the June 16, 2026 First Amended Complaint did not restart that period. See Fed. R. Civ. P. 4(m); 28 U.S.C. § 1448. The Court further notes that Plaintiffs' 14 Motion for Alternative Service was denied without prejudice by the Court's June 10, 2026 15 Text Order, with leave to renew upon curing the deficiencies identified in that Order. Accordingly, on or before September 3, 2026, Plaintiffs shall show cause why their claims against Singh should not be dismissed without prejudice under Rule 4(m), describing with specificity their efforts to locate and serve him and addressing whether good cause or other grounds warrant an extension and, if so, proposing a firm deadline and method for completing service. The Court also notes that 37 is docketed as MTL Transport, Inc.'s Answer to G3 Enterprises, Inc.'s Crossclaim, but portions of the filing request relief on behalf of Singh, and the signature block identifies counsel as representing both MTL and Singh. On or before September 3, 2026, counsel shall clarify whether they represent Singh, whether Singh intended to appear through 37 , and whether Singh waives service of process. Entered by Magistrate Judge Ronald L. Hanna on August 21, 2026. (NL)
