ELECTRONIC ORDER:
The Court is in receipt of Plaintiff's Certificate of Interested Persons and Disclosure Statement (the "Certificate") (Doc. No. 8). Defendant U.S. Xpress, Inc. removed this case to federal court invoking diversity jurisdiction under 28 U.S. C. &sect 1332(a). Doc. No. 1 at 3. Where the federal court's subject matter jurisdiction is premised on &sect 1332(a) diversity, Rule 7.1(a)(2) of the Federal Rules of Civil Procedure requires each party to file a disclosure statement that must "name--and identify the citizenship of--every individual or entity whose citizenship is attributed to that party[.]" Fed. R. Civ. P. 7.1(a)(2) (emphasis added). Plaintiff's Certificate does not include the required disclosure of his citizenship.
By August 5, 2026, Plaintiff shall file an amended certificate that includes the required disclosure statement of his STATE citizenship, NOT residency. See Preston v. Tenet Healthsystem Mem'l Med. Ctr., Inc., 485 F.3d 793, 797-98 (5th Cir. 2007) (residency does not equate to citizenship for diversity purposes).
